The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB544, s. 1 Section 1. 16.964 (1) (gm) of the statutes is created to read:

AB544,3,4 16.964 (1) (gm) Collect data relating to the number and nature of violations of ss. 940.302 (2) and 948.051 and publish statistics relating to the violations. The data shall include all of the following:

AB544,3,5 1. Numbers of investigations, arrests, prosecutions, and convictions of persons.

AB544,3,7 2. Demographics of victims, including nationality, age, method of recruitment, and country, state, or city of origin.

AB544, s. 2 Section 2. 48.355 (2d) (a) 2. of the statutes is renumbered 48.355 (2d) (a) 2. (intro.) and amended to read:

AB544,3,10 48.355 (2d) (a) 2. (intro.) "Sexual abuse" means a any of the following:

AB544,3,12 a. A violation of s. 940.225, 944.30, 948.02, 948.025, 948.05, 948.051, 948.055, 948.06, 948.085, 948.09 or 948.10 or a.

AB544,4,2 48.371 (3) (d) Any involvement of the child, whether as victim or perpetrator, in sexual intercourse or sexual contact in violation of s. 940.225, 948.02, 948.025, or 948.085, prostitution in violation of s. 944.30, trafficking in violation of s. 940.302 (2) if s. 940.302 (2) (a). 1. b. applies, sexual exploitation of a child in violation of s. 948.05, trafficking of a child in violation of s. 948.051, or causing a child to view or listen to sexual activity in violation of s. 948.055, if the information is necessary for the care of the child or for the protection of any person living in the foster home, treatment foster home, group home, or residential care center for children and youth.

AB544,5,2 48.417 (1) (d) A court of competent jurisdiction has found that the parent has committed a violation of s. 940.19 (3), 1999 stats., a violation of s. 940.19 (2), (4), or (5), 940.225 (1) or (2), 948.02 (1) or (2), 948.025, 948.03 (2) (a) or (3) (a), 948.051, or 948.085, a violation of s. 940.302 (2) if s. 940.302 (2) (a) 1. b. applies, or a violation of the law of any other state or federal law, if that violation would be a violation of s. 940.19 (2), (4), or (5), 940.225 (1) or (2), 948.02 (1) or (2), 948.025, 948.03 (2) (a) or (3) (a), or 948.085 listed under this paragraph if committed in this state, and that the violation resulted in great bodily harm, as defined in s. 939.22 (14), or in substantial bodily harm, as defined in s. 939.22 (38), to the child or another child of the parent. If the circumstances specified in this paragraph apply, the petition shall be filed or joined in within 60 days after the date on which the court assigned to exercise jurisdiction under this chapter determines, based on a finding that a circumstance specified in this paragraph applies, that reasonable efforts to make it possible for the child to return safely to his or her home are not required.

AB544, s. 10 Section 10. 51.20 (13) (ct) 2m. of the statutes is amended to read:

AB544,6,14 51.20 (13) (ct) 2m. If the subject individual is before the court on a petition filed under a court order under s. 938.30 (5) (c) 1. and is found to have committed a violation, or to have solicited, conspired, or attempted to commit a violation, of s. 940.22 (2), 940.225 (1), (2), or (3), 944.06, 948.02 (1) or (2), 948.025, 948.05, 948.051, 948.055, 948.06, 948.07, 948.075, 948.08, 948.085, 948.095, 948.11 (2) (a) or (am), 948.12, 948.13, or 948.30, of s. 940.302 (2) if s. 940.302 (2) (a) 1. b. applies, or of s. 940.30 or 940.31 if the victim was a minor and the subject individual was not the victim's parent, the court shall require the individual to comply with the reporting requirements under s. 301.45 unless the court determines, after a hearing on a motion made by the individual, that the individual is not required to comply under s. 301.45 (1m).

AB544, s. 11 Section 11. 178.27 (3) of the statutes is created to read:

AB544,6,18 178.27 (3) Upon application by a district attorney or the attorney general, the court shall decree a dissolution if the partnership has violated s. 940.302 (2) or 948.051 (2).

AB544, s. 12 Section 12. 178.45 (1m) of the statutes is created to read:

AB544,6,23 178.45 (1m) Upon application by a district attorney or the attorney general, a court shall revoke a foreign registered limited liability partnership's certificate of authority if the foreign registered limited liability partnership has violated s. 940.302 (2) or 948.051 (2).

AB544, s. 13 Section 13. 179.72 of the statutes is renumbered 179.72 (1).

AB544, s. 14 Section 14. 179.72 (2) of the statutes is created to read:

AB544,7,3 179.72 (2) On application by a district attorney or the attorney general, the circuit court shall order dissolution of a limited partnership, if the limited partnership has violated s. 940.302 (2) or 948.051 (2).

AB544, s. 15 Section 15. 179.86 (3) of the statutes is created to read:

AB544,7,7 179.86 (3) Upon application by a district attorney or the attorney general, a court shall cancel the registration of a foreign limited partnership if the foreign limited partnership has violated s. 940.302 (2) or 948.051 (2).

AB544, s. 16 Section 16. 180.1420 (6) of the statutes is created to read:

AB544,7,9 180.1420 (6) The corporation violates s. 940.302 (2) or 948.051 (2).

AB544, s. 17 Section 17. 180.1530 (1) (g) of the statutes is created to read:

AB544, s. 18 Section 18. 181.1420 (7) of the statutes is created to read:

AB544,7,14 181.1420 (7) Human trafficking. The corporation violates s. 940.302 (2) or 948.051 (2).

AB544, s. 19 Section 19. 181.1530 (1) (g) of the statutes is created to read:

AB544,7,16 181.1530 (1) (g) The foreign corporation violates s. 940.302 (2) or 948.051 (2).

AB544, s. 20 Section 20. 250.04 (14) of the statutes is created to read:

AB544,7,20 250.04 (14) (a) Subject to the availability of funds and to par. (b), the department may provide or fund emergency services or assistance to victims of s. 940.302 (2) or 948.051.

AB544,7,22 (b) The department may provide or fund emergency services or assistance to a victim only for the following time periods:

AB544,7,24 1. If the victim is cooperating with the appropriate law enforcement agencies, from the time the victim is identified until 60 days after the disposition of the trial.

AB544,8,2 2. If the victim is not cooperating with the appropriate law enforcement agencies, a total of 60 days.

AB544, s. 27 Section 27. 440.982 (2) of the statutes is amended to read:

AB544,9,14 440.982 (2) The department may not grant a license under this subchapter to any person who has been convicted of an offense under s. 940.22, 940.225, 944.06, 944.15, 944.17, 944.30, 944.31, 944.32, 944.33, 944.34, 948.02, 948.025, 948.051, 948.06, 948.07, 948.075, 948.08, 948.09, 948.095, 948.10, 948.11, or 948.12 or under s. 940.302 (2) if s. 940.302 (2) (a) 1. b. applies.

AB544, s. 28 Section 28. 901.04 (3) (c) of the statutes is amended to read:

AB544,9,19 901.04 (3) (c) In actions under s. 940.225, 948.02, 948.025, 948.051, 948.085, or 948.095, or under s. 940.302 (2), if the court determines that the offense was sexually motivated, as defined in s. 980.01 (5), admissibility of the prior sexual conduct or reputation of a complaining witness.

AB544, s. 29 Section 29. 938.34 (15m) (bm) of the statutes is amended to read:

AB544,9,25 938.34 (15m) (bm) If the juvenile is adjudicated delinquent on the basis of a violation, or the solicitation, conspiracy, or attempt to commit a violation, of s. 940.22 (2), 940.225 (1), (2), or (3), 944.06, 948.02 (1) or (2), 948.025, 948.05, 948.051, 948.055, 948.06, 948.07, 948.075, 948.08, or 948.085 (2), 948.095, 948.11 (2) (a) or (am), 948.12, 948.13, or 948.30, of s. 940.302 (2) if s. 940.302 (2) (a) 1. b. applies, or of s. 940.30 or 940.31 if the victim was a minor and the juvenile was not the victim's parent, the court shall require the juvenile to comply with the reporting requirements under s. 301.45 unless the court determines, after a hearing on a motion made by the juvenile, that the juvenile is not required to comply under s. 301.45 (1m).

AB544, s. 30 Section 30. 939.46 (1m) of the statutes is created to read:

AB544,10,10 939.46 (1m) A victim of a violation of s. 940.302 (2) or 948.051 has an affirmative defense for any offense committed as a direct result of the violation of s. 940.302 (2) or 948.051 without regard to whether anyone was prosecuted or convicted for the violation of s. 940.302 (2) or 948.051.

AB544, s. 34 Section 34. 939.74 (2) (d) of the statutes is created to read:

AB544,11,3 939.74 (2) (d) A prosecution for a violation of s. 948.051 shall be commenced before the victim reaches the age of 24 or be barred.

AB544, s. 35 Section 35. 940.302 of the statutes is created to read:

AB544,11,5 940.302 Human trafficking. (1) In this section:

AB544,11,7 (a) "Commercial sex act" means sexual contact for which anything of value is given to, promised, or received, directly or indirectly, by any person.

AB544,11,11 (b) "Debt bondage" means the condition of a debtor arising from the debtor's pledge of services as a security for debt if the reasonable value of those services is not applied toward repaying the debt or if the length and nature of the services are not defined.

AB544,11,13 (c) "Services" means activities performed by one individual at the request, under the supervision, or for the benefit of another person.

AB544,11,16 (d) "Trafficking" means recruiting, enticing, harboring, transporting, providing, or obtaining, or attempting to recruit, entice, harbor, transport, provide, or obtain, an individual without consent of the individual.

AB544,11,18 (2) (a) Except as provided in s. 948.051, whoever knowingly engages in trafficking is guilty of a Class D felony if all of the following apply:
